California Judge Rules Against SDUSD Vaccine Mandate

A California Superior Court judge has ruled that San Diego Unified School District CANNOT issue a COVID-19 vaccine mandate for students and prohibit unvaccinated students from attending school in person!

“The sole function of this Court is to determine whether the Roadmap is preempted by state law. SDUSD's Roadmap appears to be necessary and rational, and the district's desire to protect its students from COVID-19 is commendable. Unfortunately, the field of school vaccine mandates has been fully occupied by the State, and the Roadmap directly conflicts with state law. The addition of a COVID-19 vaccine mandate without a personal belief exemption must be imposed by the Legislature. Accordingly, this Court is compelled to GRANT the petitions for writ of mandate.”

Regardless of where you live in California, COVID-19 vaccine mandates cannot be issued by any school district. The Parent Association, Inc. encourages eligible people to get vaccinated against COVID-19, especially those who are older or have health risks. However, if your child is being prevented from attending school in person due to COVID-19 vaccine status, printout the ruling available below, highlight the last sentence on page 4, and attach a cover letter saying:

The attached ruling was issued by San Diego Superior Court Judge John S. Meyer on December 20, 2021. Under the Constitution of the State of California, my child is entitled to attend our public school and receive in person instruction. Until or unless the SDUSD’s attorney provides me an explanation, in writing, for why the school is defying this ruling, my student will be attending school in person. Any further discussion or communication about my child’s enrollment or attendance at school for her normal class schedule will be accepted only in writing.
